Terms & Conditions

These terms and conditions govern your use of the Cool Earth Action website (the "Cool Earth Action Site") and the making of donations to Cool Earth Action for the purposes of ecosystem conservation. Please read them carefully as they affect your rights and liabilities under the law.

If you do not agree to these terms and conditions, please do not register for or use the Cool Earth Action Site. If you have any questions please contact info@coolearth.org.

Who we are

Cool Earth Action is a company limited by guarantee registered in England and Wales (number 06053314) with a registered office at

and is a registered charity (number 1117978).

Registration

You must ensure that the details provided by you on registration for the Cool Earth Action Site or at any time are correct and complete.

You must inform us immediately of any changes to the information that you provided when registering by updating your personal details in order that we can communicate with you effectively.

Password and security

When you register to use the Cool Earth Action Site you will be asked to create a password. In order to prevent fraud, you must keep this password confidential and must not disclose it or share it with anyone. If you know or suspect that someone else knows your password you should notify us by contacting us at info@coolearth.org immediately.

If Cool Earth Action has reason to believe that there is likely to be a breach of security or misuse of the Cool Earth Action Site, we may require you to change your password or we may suspend your account.

Donations

All donations made to Cool Earth Action will be used to fund the work of Cool Earth Action and its partners in conserving critical ecosystems, investing in rainforest communities and preventing deforestation. These partners include, but are not limited to Fauna and Flora International and Ecotribal. Funds raised from the sponsorship of specific acres will be used by Cool Earth Action to fund all its activities and projects and are not limited to the acreage sponsored.

Cool Earth Action is not offering for sale any land or biomass. Donors will not receive title to the land sponsored or to the ‘emissions reductions' achieved by any of Cool Earth Action's projects.

Your credit or debit card details will be encrypted to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of placing your order.

Currency

Donations will be taken in pounds sterling. International donations will be converted to a sterling value at the exchange rate of the day.

What you will receive

As a donor, you will receive an email confirming your donation to Cool Earth Action. For sponsorship of rainforest and other ecosystems, the email will confirm the area of land that your donation represents.

The confirmation email sent to you by Cool Earth Action is only to acknowledge the value of your donation. It does not place any liability upon Cool Earth Action and does not constitute or imply a contract.

Emissions Calculations

Cool Earth Action bases its emissions calculations upon the most up to date emissions factors published in the Stern Review. These emissions factors can and do change over time. If new information is published, Cool Earth Action will not acquire any responsibility to alter its emissions reductions liability for calculations that it has done in the past.

Administration fee

Cool Earth Actions estimates that less than 10% of its income will be required to cover administrative, resource and equipment costs.

UK taxpaying donors are encouraged to tick the Gift Aid box when making a donation. Where the Gift Aid Scheme applies, Cool Earth Action is able to reclaim 28% of the amount of donation from the government.

Cancellation

You may cancel donations made by cheque or debit or credit card payment to us at any time prior to payment being transferred from your bank or credit card account to Cool Earth Action. There may be a charge from your own bank or card provider for doing this.

Your use of the Cool Earth Action Site

You may not use the Cool Earth Action Site for any of the following purposes:

(a) disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material or otherwise breaching any laws;

(b) transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any applicable laws, regulations or code of practice;

(c) interfering with any other person's use or enjoyment of the Cool Earth Action Site; or

(d) making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.

You will be responsible for our losses and costs resulting from your breach of any of the above.

Intellectual Property

The content of the Cool Earth Action Site is protected by copyright, trade marks, database right and other intellectual property rights. You may retrieve and display the content of the Cool Earth Action Site on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices.

You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Cool Earth Action Site without written permission from Cool Earth Action.

Availability of the Cool Earth Action Site

Although we aim to offer you the best service possible, we make no promise that the services at the Cool Earth Action Site will meet your requirements. We cannot guarantee that the service will be fault-free. If a fault occurs in the service you should report it to us at info@coolearth.org and we will attempt to correct the fault as soon as we reasonably can.

Your access to the Cool Earth Action Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the service as soon as we reasonably can.

Suspension or cancellation of your registration

Cool Earth Action may suspend or cancel your registration immediately at its reasonable discretion or if you breach any of your obligations under these terms and conditions.

You can cancel your registration at any time by informing Cool Earth Action in writing at info@coolearth.org. If you do so, you must stop using the Cool Earth Action Site.

The suspension or cancellation of your registration and your right to use the Cool Earth Action Site shall not affect either party's statutory rights or liabilities.

Cool Earth Action's Liability

The Cool Earth Action Site provides content from other Internet sites or resources and whilst Cool Earth Action tries to ensure that material included on the Cool Earth Action Site is correct, reputable and of high quality, it does not make any warranties or guarantees in relation to that content. If Cool Earth Action is informed of any inaccuracies in the material on the Cool Earth Action Site we will attempt to correct the inaccuracies as soon as we reasonably can.

If we are in breach of these terms & conditions, we will only be responsible for any losses that you suffer as a result to the extent that they are a foreseeable consequence to both of us at the time you make the relevant order. Our liability shall not in any event include business losses such as lost data, lost profits or business interruption.

Third Party Websites

As a convenience to customers, the Cool Earth Action Site includes links to other web sites or material which are beyond its control. Cool Earth Action is not responsible for content on any site outside the Cool Earth Action Site.

Advertising and Sponsorship

Part of the Cool Earth Action Site may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Cool Earth Action Site complies with relevant laws and codes. We will not be responsible to you for any error or inaccuracy in advertising and sponsorship material.

Applicable Law

These terms and conditions will be subject to the laws of England and Wales. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so within the United Kingdom.

International Use

We make no promise that materials on the Cool Earth Action Site are appropriate or available for use in locations outside the United Kingdom, and accessing the Cool Earth Action Site from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.

Verification

Each of the Cool Earth Action projects will have its projects monitored by a third party to the standards required by its trustees.

Data Protection

Cool Earth Action is committed to retaining the confidentiality of its customers and will not pass personal data on to any third party. However, where we have websites that are co-branded with a partner organisation we may in some circumstances be required to share information on the identity of parties making a purchase with the partner organisation.

Amendments

We may update these terms and conditions from time to time for legal or regulatory reasons or to allow the proper operation of the Cool Earth Action Site. Any changes will be notified to you via the email address provided by you on registration or via a suitable announcement on the Cool Earth Action Site. The changes will apply to the use of the Cool Earth Action Site after we have given notice.

If you do not wish to accept the new terms and conditions you should discontinue use of the Cool Earth Action Site. If you continue to use the Cool Earth Action Site after the date on which the changes comes into effect, your use of the Cool Earth Action Site indicates your agreement to be bound by the new terms and conditions.

Miscellaneous

You may not transfer any of your rights under these terms and conditions to any other person. We may transfer our rights under these terms and conditions to another business where we reasonably believe your rights will not be affected.

If you breach these terms and conditions and Cool Earth Action chooses to ignore this, Cool Earth Action will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the terms and conditions.

Cool Earth Action shall not be responsible for any breach of these terms and conditions caused by circumstances beyond its reasonable control.
